Introduction

Elkapsling AB cares about the integrity of its customers and employees. This personal data policy contains information about how Elkapsling processes personal data, and what rights data subjects have.
Elkapsling is the data controller (for the employees) and responsible for the processing carried out by Elkapsling in accordance with this personal data policy.
Elkapsling will only collect and process personal data in accordance with this personal data policy as well as the General Data Protection Regulation (EU 2016/679) and national legislation that supplements the General Data Protection Regulation.

Processing of personal data

Elkapsling processes personal data about the following categories of data subjects:

Employees: Natural persons who are employed by Elkapsling
Customers: Natural persons who are either themselves a customer of Elkapsling or act as representatives, contact persons or employees of a company, association, organization, supplier or partner.
Leads/Prospects: Natural persons who may be can become a potential customer
Job seekers: Natural persons who apply for advertised positions at Elkapsling and have submitted to Elkapsling
Consultants: Natural persons who carry out consultancy assignments for Elkapsling or its customers
Business associates: Natural persons with whom Elkapsling’s employees have an established relationship in order to carry out their daily assignments
Relatives: Contact information for relatives of employees at Elkapsling
Suppliers: Suppliers of consumables and materials
Trainee: School trainees
Board members: Personal data from persons who have a board assignment

Those who contact Elkapsling: Natural persons who visit Elkapsling’s website, social media, office, e-mail, telephone or in any other way contact Elkapsling and provide personal data in connection with such contact

Storage and computing capacity are provided in Sweden. Administration of systems for storage and computing capacity takes place in Sweden.
Elkapsling shall ensure that sub-processors are bound by written agreements that impose the same obligations on them in the processing of personal data as the obligations that apply under the data processing agreement.
Personal data processed by the controller in the services is not used by Elkapsling for the purpose of improving the services.

Legal basis for the processing

Elkapsling collects and processes personal data for the following purposes based on the following legal bases: See section “Processing of personal data”.
The data subject may, at any time, object to Elkapsling’s processing of the data subject’s personal data for the purpose of marketing.

Retention of personal data

Elkapsling stores personal data for as long as it is necessary based on the purposes of the personal data processing. See the section “Processing of personal data.”

Disclosure and Sharing of Personal Information

Elkapsling may disclose personal data to third parties to the extent necessary to safeguard Elkapsling’s customers’ interests, to carry out an assignment or if disclosure is required by applicable law. Electrical enclosure will always take confidentiality into account before any handover takes place. Extradition may take place to, for example, courts, arbitral institutions, authorities, and partners.
When transferring personal data, Elkapsling remains the data controller for its own processing, while the receiving third party either becomes the data controller for its further processing or the data processor of Elkapsling, based on the circumstances of the specific case.
Elkapsling may engage personal data processors who provide, for example, IT services and telephony. In that case, Elkapsling will enter into the necessary data processing agreements with the data processor, to ensure that the data processor’s personal data processing is carried out in accordance with Elkapsling’s instructions and applicable law.

Security and geographical location of the processing of personal data

Elkapsling takes appropriate technical and organisational measures to ensure a level of security that is appropriate to the risk, including ensuring that personal data is protected against unlawful access, loss and destruction.
Essentially, Elkapsling will process your personal data within the EU and EEA. However, Elkapsling may process personal data outside the EU and EEA. In that case, Elkapsling will take the necessary measures to ensure that the processing takes place in a secure manner and in accordance with applicable legislation, including the General Data Protection Regulation.

Your rights as a data subject

The General Data Protection Regulation (GDPR) gives data subjects a number of rights with regard to the processing of personal data. It is Elkapsling’s task to fulfil these rights as a data controller.

Right of access: You have the right to obtain confirmation as to whether or not your personal data is being processed by Elkapsling, and in such cases receive a copy of the personal data and certain information about the processing. With reference to the General Data Protection Regulation, Elkapsling cannot disclose personal data if it may adversely affect the rights and freedoms of others.

Right to rectification: If the personal data being processed is incorrect or incomplete, the data subject may request Elkapsling to correct it without undue delay.

Right to erasure: In some cases, the data subject has the right to request the erasure of his or her personal data (“right to be forgotten“). An example is when the personal data is no longer necessary for the purposes for which it was collected or otherwise processed. However, there may be contractual relationships or legal requirements that mean that Elkapsling cannot delete your personal data.

Right to data portability: The data subject has the right to transfer personal data that he or she has provided to Elkapsling to another personal data controller if the processing is supported by the legal grounds of performance of an agreement or consent. The personal data shall be provided to the data subject in a structured, commonly used and machine-readable format. If technically feasible, the data subject may request that the data be transferred directly to another controller. This right only applies to the personal data that the data subject has provided to Elkapsling.

Right to restriction of processing: In certain cases, the data subject has the right to demand that Elkapsling restricts the processing of his or her personal data, i.e. restricts the processing to certain purposes. The right to restriction applies, among other things, when the data subject considers the data to be incorrect and has requested that the personal data be corrected. In such cases, the data subject may request that the processing of their personal data be restricted while the accuracy of the data is being investigated. When the restriction ends, the individual must be informed of this.

Legitimate interest

Right to object: The data subject has the right to object to the processing of personal data that is based on the legal basis of legitimate interest. In the event of an objection, Elkapsling shall cease the processing unless compelling legitimate grounds for the processing can be demonstrated which override the interests, rights and/or freedoms of the data subject or if the processing of personal data is carried out for the establishment, exercise or defence of legal claims.

Right to object to direct marketing: When personal data is processed for direct marketing purposes, the data subject has the right to object to the processing of their personal data at any time. If a data subject objects to the processing of personal data for direct marketing purposes, the processing for such purposes shall cease.

Offers and benefits

In order to provide you with offers and benefits such as discounts, special events, priority access to products, sale promotions, samples, gifts, etc., we look at your past events.

Elkapsling and its business partners will not use any direct marketing channel for this purpose (e.g. e-mail or SMS) if you have chosen to unsubscribe from marketing.

Changes to the Policy

Electrical Enclosure may update and change this policy from time to time. In the event of major changes, Elkapsling will inform about the changes in an appropriate manner, for example by publishing the updated policy on Elkapsling’s website.
